okay looks like we’re getting people to join in hi everybody happy Friday we’re going to get a few minutes and or a few seconds and and let everybody get in here you know how technology likes to hold people in that waiting room today we are talking about English language proficiency the out of service um violation that’s coming down on Wednesday June 25th it’s coming up quickly um so I have Chuck and Steve here we are all um well Steve is in our Dallas office but Chuck and I are coming to you live from behind the Pine Curtain in East Texas here in Texarkana where our headquarters is chuck is our director of client success and you if you haven’t seen his face you’ve definitely seen his name in your inbox because I know you all know your client success reps really well and um they all report up through him and I’m the director of marketing and strategic partnerships and whatever else needs doing here and we are very glad to share the latest on what’s going on so just to give a quick rundown of where we are and what’s happening um April 28th an executive order was issued calling FMCSA to um issue new guidance regarding the English language proficiency requirement under CFR 391.11B2 um it’s that one’s been in place since what 2007 something like that and then in 2016 there was an executive order that kind of softened enforcement so it was not an out-of-service violation starting in about 2016 well the call and mandate to FMCSA is to make it an out-of-service violation and to resume enforcement of that um so we saw late May FMCSA issued the guidance on this and um enforcement will begin on June 25th that’s Wednesday coming up and um we managed to get our hands on the unredacted version of the guidance document so we’ve used that to develop a couple of tools some you’ll be comfortable and familiar with within the INFINITI training platform that you’re used to and some are actually brand new tools that we’ve just created we we’ve been busy busy coding on a new product and this was just the perfect opportunity to test it out so we were planning to release that product at the end sometime in the late summer but you know when need calls we rise so here we are rolling out today so um with that I’m going to show you kind of the first part which is what exists today right now you can kind of assign it like you normally would within your training site and then um Chuck’s going to jump in and show you this new product that we have turning on for everyone at the top of next week both tools are going to be really helpful for you um in one evaluating your entire fleet for the 25th enforcement um and then also for helping to um you know give some training tools to your drivers who might be struggling and then also incorporating this into your ongoing recruiting and pre-orientation practices just to make sure that as an ongoing effort you’re continuing to recruit and hire qualified drivers so that’s what’s going on of course we know what what all is at stake here if we send drivers out who are not qualified we run the risk of having them get popped in a roadside and then you have to fly or drive somebody else out to go pick up driver and truck or have it towed which has its own problems there those violation points of course and um of course downtime we can’t we can’t keep those clients waiting on their load to get delivered so a lot at stake here a couple of things I think it’s important to remember in the guidance issued um one is that uh translation tools or support tools not allowed in the roadside in in in the roadside assessment so a driver up until now has been able to use a translation app um or another tool to help communicate with officers under the new guidance that is not allowed they will not be able to do that so remember that when you’re evaluating your fleet um they won’t be able to use it in real life so they probably shouldn’t be able to use it in that evaluation within the company that’s one second thing really important to remember is that um the the the grading has not been mentioned okay so um the guidance that we have seen so far and if you know if you see something else please tell us but the guidance that we’ve seen so far um doesn’t mention what it means to pass or fail so how many road signs can a driver mess up um at what point do they stumble in conversation does that flag to an officer that they need to continue with the evaluation so until that is issued you the company are going to have to decide what you determine an appropriate level of risk when you’re hiring and dispatching drivers um gosh I think that’s all the quote legalese the the special stuff know is there anything you want to add to this Chuck

okay all right great well let’s dive right in so um we’ve been busy busy and we’ve produced a couple of tools what I’m going to show you right now is what’s available right now live in the Infiniti platform that can be assigned today to your drivers what we’ve heard is that um some of our clients are planning to do this as the first pass and assign it to their entire fleet and use that um as a gauge for who needs additional screening um so what we have today let me just go ahead and share my screen here and I’m going to be looking at my other Where am I looking right over here i have a bunch of monitors let’s see okay I think you should be able to see my screen now and by the way feel free to hop in chat ask us any questions if I could turn people’s cameras on and allow you to talk I would but I don’t know how to set that up so if you have questions pop them in chat okay so we’re going to log in of course I hope you all have your own logo on the site we’re going to log in here as an administrator first things first I have this set up to go to the announcements page first we do have this flyer available we have a couple of iterations of this flyer this particular one talks about the two regulation changes going into effect next week on the 23rd there’s the medical certification process that’s going into effect and of course on the 25th English language proficiency so um we’ve set this up so that you can go to the flyer and the announcements page as soon as you log in if you would like to do that please let your client success rep know they will be glad to help you set that up we have that flyer available we also have a standalone about English language proficiency and a standalone about the medical certification process so you know pick and choose what you need then um let’s go over to assignments really quickly we’re going to create a new assignment everyone here on this call should be familiar we’re going to call this English language proficiency can I proficiency June 2026 um initial evaluation that’s what I’m going to call it we’re going to have it start today and I know many of you will want to get this in place and assigned before the 25th it’s a quick turnaround um again passing grade remember that’s going to be at your company’s discretion we haven’t seen guidance yet from the FMCSA on this so y’all decide at the company level what um is an appropriate risk um for now I’m going to put it at 100% and obviously you can just choose whatever settings and configurations you have enabled for your specific training site let’s go next for content when we’re adding content we’re going to search English language and the first three content items are going to be the ones you will probably want to add this is a video very short to the point a minute and 45 seconds um explaining the regulation and the changes and what’s going on we’re going to add that then we also have two quizonly assignments and I’ll show you what that looks like one is um for the conversational practice and one is for the road sign practice because as the um enforcement guidance has been written first the officer will have a conversation with the driver and ask typical questions that you would ask roadside and then if there’s an issue in that conversation they will do further testing with a road sign quiz that’ll be conducted roadside so two steps starting with conversational road sign so I have all three added um next we’re going to go to groups you can always assign companywide if you have specific user groups that you’re really concerned about and you want to target them first be it by terminal or by you know some of you I know have your your stuff organized by driver versus mechanic or by um Spanish speaker or other language speech so choose what works for you i’m going to assign this to my test user Craig notifications y’all know the drill here and tags you know I think for me this would be a great one for tags regarding regulation if you have a regulation tag added if you’re making this part of your upcoming July training then you might want to add it to the ongoing training tag tags are going to be a great tool for to use in all of your training assignments for reporting purposes so don’t forget to use those let’s publish this okay assignment successfully created so I’m going to jump over to Craig’s test user so you can see what it looks like we’re logging in as the driver right now again it’s going straight to the announcements page so I I the driver can see what’s going on and then I’m going to jump into my classroom and you can see that we have the video here and then um the the quiz only assessments you all know what a video looks like let’s start the quiz only test so you can see so first things first conversational um it’s important to remember that that reading and responding to written word very different from being able to understand and speak live um so we have a a different way to evaluate for that that Chuck’s going to share but this is really meant to be something that helps prepare your drivers something they can study something that lets you kind of know where they stand um and it’s all of the questions that have been pulled from the the enforcement guidance all of the questions that were listed there for officers to ask roadside doesn’t mean they can’t ask others but it’s what lifted listed in the formal document so um as you see what number would you call if you had a problem and then here are some potential responses that the the driver might say so there are 13 questions that you could go through this is a graded quiz um so you’ll be able to see who passed or failed let’s jump back out and look at the traffic sign version um okay here we go so this is is pretty typical for what the rest of the questions look like it shows a set of four um signs some of them are digital signs some of them are construction again this came from the unredacted version of the enforcement document and we added some additional signs that we know drivers need to be aware of like signs from construction zones other safety sensitive let’s remember we don’t want to just be compliant we want to be really truly safe and prepared to do the job so um training beyond compliance is always our our starting point so drivers are going to come through and answer look at the picture answer the question and move on and this is a graded test so again at the end of this you can see which drivers passed or failed that’s a mouthful i don’t see any questions in chat if we have any questions please feel free to pop them in otherwise I think what we’ll do is we’ll let Chuck you know Chuck do you have anything to add to that the way that’s set up or way clients can use that right now
uh no just to your point it’s a great tool to start your preliminary evaluation before you move into the assessment um it’s it’s um a great alternative that we just recently uh discovered that we need it in order to uh better serve you uh and I think it’ll you’ll see how it correlates with uh the checklist as I pull it up let’s see are you able to see my screen

cool all right so um we have released our we’re in the process of releasing our digital checklist uh and as Lydia stated earlier we were going to release it a little later u in the summer but the order really uh required us to get a little speed behind it so I’m going to show you how to go through our workflow it’s pretty intuitive and a easy way to go ahead and go through the whole evaluation process as it states in the regulation all right so um I’ve taken the liberty of starting the the process so that we won’t um spend a lot of time answering questions and all that good stuff so you simply start here this is the first step in the in the workflow it’s going to come with the video uh that Lydia stated earlier uh also you’re going to have some instructions that goes along with the order and then the scenario uh to actually answer the questions uh we discovered also that um every scenario is not the same so we have uh a text box that’s going to be coming up that uh you’ll be able to put your own uh scenario in there so let me go through this it’s a pass fail based on your preference um you go through all the question that Lydia just showed you at the bottom you will attest that the drivers are proficient or not you have the ability to actually do a signature or type

date and now I’m going to pass along excuse me the assessment to my my actual driver

do it thing all right so now that I’ve completed my in-person um assessment I’m going to start the the process um the digital checklist is already set up for the uh assessment on the driver’s side you can see she’s already went through some of the slides

yes um so now that we’ve completed the the assessment again this is this doesn’t have a grading mechanism use the quiz only to actually get that grading mechanism uh to see where your drivers stand the driver will send that back to the trainer

okay so now that step one and step two of the the regulations completed as you can see here we’re at step three um we’ll start that process in order to uh review the the um the assessment before you sign off you’ll click this little I

and again you can scroll down through all those 60 questions uh and just evaluate at your own discretion if you feel that that the answers are adequate for your company and uh the standard that you’re looking for as it uh pertains to the uh English language proficiency at this point you will test whether they’re proficient yes or no sign off as the recruiter save date and we’re done with the workflow and you have completed that whole assessment uh it’s a pretty smooth flow um to go through with your drivers again I like the initial evaluation that Lydia showed us early on because it gives you an opportunity to really evaluate if we need to go through this process or not um when we start to evaluate drivers um yeah it’s that’s it i mean it’s pretty smooth
I think um two what I like about this is it’s two solutions one you’re you’re already familiar and comfortable with and again it doesn’t the order of the quiz only in the video it doesn’t necessarily meet the flow of the regulation or that conversational piece but boy it’s a good way to evaluate where you stand today with all of your drivers like Chuck said then then use this digital checklist tool to go back and catch like evaluations where they’re needed um checklist tool is also really fantastic for um orientation recruiting side of things so you can evaluate them with that conversational live and in person where you want to really gauge how proficient they are uh before moving them along into your other traditional orientation training or making the offer however that goes for you i don’t see any questions in chat but I do see two Q&As’s um
what’s the difference between the checklist and assigning it as an assignment to a driver so um they’re just two different versions two different options same content just lifted a little bit differently um I say the the real benefit to checklists like we were just saying is that that lets you have a live or in-person or synchronous um conversation so think about in in the office when you’re trying to gauge speaking which is how the officer will do it that’s going to be the way to to evaluate evaluate that best um or think about you know you you bring in new recruits to the orientation program some of you I know do that live um in a classroom before assigning additional training online so um that’s the application where you would want to use that um it it lets you have that live training or live interaction component whereas assigning it through the traditional LMS is going to be just like you do you know the online remote learning at their own pace at their own discretion um and then of course graded so we we had the capability to to bring it to you both ways we wanted to to give you some options um I think each has its own place each is fitting um and we should gosh I don’t know that we even said this the digital checklist we are giving to our all of our clients for free um for the first you know for the duration of your contract basically so um this is going to be turned on for you all that’s this is not us saying like yeah but there’s a price attached to it no this is we want everyone to have the tools that they need so that’s um that’s you know something we’re glad to be able to offer another question I have in here uh you anticipate doing this test in front of the driver in person so yes again digital through the digital checklist version of this which is that three flow you know first the recruiter or the trainer is conducting the conversational evaluation then they pass it to the driver and the driver can either I mean there’s some flexibility there the driver can either fill it out right there on the computer or tablet next to the trainer or they can do it on their own time and send it back um and then the final you know sign off is given by the recruiter the trainer the company representative so that’s how that side goes um with the quiz only um applications through your LMS classroom that doesn’t have to be done in person you can assign that and they can just set a deadline and then Mike hi Mike mike is asking “How many questions in the English test?” A lot i think it’s 59 59 road sign questions and 13 conversational um the 13 could be 14 um conversational questions came directly from the unredacted guidance enforcement guidance that we’ve gotten our hands on um again that doesn’t mean that that’s exhaustive they officers may be asking more questions roadside but that’s what’s in the the guidance document that they are receiving um the road sign question it wasn’t quite 59 in the road sign version of the unredacted document but um there were a couple of other signs that we just felt it was really important to include because again it’s um high high-risk kind of areas so particularly construction or digital signage where we know there tend to be accidents around work zones there’s a whole work zone awareness week for the reason um so yes we want to help you be compliant but we really also want to make sure at the end of the day everyone is safe operating so we added a few others but I’d say it was pretty close i mean it was somewhere around 40 I think signed so we added another you know 15 or so something like that um Melanie has a question chuck I’ll let you i haven’t even se read the question but you can answer are the quiz only assignments included for free as well or just the digital checklist
yes they are included yes they are already uh should be readily available now um in the uh content catalog package and um yes digital checklist as well great yep everything included we don’t like to nickel and dime so there you go there are your tools use them as you need to randy raised his hand for a second and then he pulled that back down so I don’t know randy do you want to talk i’ll I’ll put you on live if you want to talk um oh looks like another question popped into Q&A um has there been any information released on how often a driver can be tested out on the road i haven’t seen anything have you Chuck neither have I no
I’m guessing Steve hasn’t either no
no I haven’t i haven’t heard any anything like that and we also I think this might be a place to say that we also don’t know if a driver is put out of service what the criteria are for them to be placed back in service so uh there’s a little bit of uh stuff here that I think will be determined probably fairly quickly but we don’t know that today yep yep yeah that’s uh pretty frustrating I have to say to not know that going into it because we know this is going to be it’s already being checked roadside we’ve already heard feedback that officers are practicing this evaluation it just it’s not out of service yet so um they’re going to have to have an answer for that pretty quick because it’s going to impact a ton of drivers um so when we hear we will share if y’all hear please share with us so we can get the word out the the the more eyes paying attention to this the better um okay Daniel says “All the Daniel I think we met at boot camp.” Anyway that’s that’s another story all of Yes we did hi Daniel all of the question signs and the and the other are multiple choice um multiple choice so yes uh in both settings multiple choice yep there’s only one correct answer per per sign question though

yep um thanks Daniel randy will the driver be reading the questions at roadside or will the questions be verbally given verbally given is our understanding um so again our understanding of this we’ll see more once it becomes you know carried out actually enforced roadside but um the the conversation itself will will be done verbally it’ll be just like you would have an interaction when you’re pulled over can I see your your CDL you know what are you hauling where you headed that kind of thing um and then based on the way I read the enforcement guidelines I believe that the road sign test will be a visual so they’ll point to a picture and say “What does this mean?” Um again we’ll know more once the enforcement’s carried out and please tell us what you’re seeing out there um Austin’s asks “If the driver is placed out of service for how many hours would he be placed out of service?” I don’t know Steve
no that’s what we don’t know uh what the criteria are for coming back and you know how that’s going to be determined it’s sad to say that but that’s what we know today

ah you’re referring to my test pardon let me reread that then will the driver be reading the questions at roadside or will the questions be verbally given to the driver so um on on the test if you’re using the digital checklist flow for this then they should be verbally given the first step in that flow is for the trainer or the recruiter whoever the company representative is to to read them out to ask the question out loud to driver and have the driver respond and so in in listening to the response they’re going to say “Pass yes they can sufficiently speak English for company standard or fail they they can’t.” um on the quiz only side of things so if you’re going into you know your INFINITI Training site going into a typical assignment to the classroom and you’re adding the quiz only they’re going to read it um so the conversational quiz only they’ll be reading the question they’ll be reading the possible responses and selecting that’s why I don’t just love that as the sole means to evaluate your fleet but I get it we we have to get everyone kind of squared away for day one
um but yes it will be conducted conversationally so I think that’s why digital checklist for me anyway is the winner on evaluation

and one other thing Lydia you know to that I think it’s important to pull out is they did make some exception they made an exception to this out of service rule for those companies that uh do business right along the borders both with Mexico and uh Canada uh they would still be violated but they won’t be put out of service now that may change in the future uh but right now especially for our companies that may have B1 drivers that uh you know transport into other countries um there they’ve made an an exception for that at least for the time being so they’ll still be violated but no out of service
that’s really good to know i don’t think we have that available on our site yet so we’ll have to add that Steve because what is Laredo is still the largest port in the world right
yeah and you know uh drivers in those areas close to the border you know will uh not be put out of service could be violated though
that’s good we’ll get that information up and live um to share out as well a couple more questions coming in David made a comment that there are CDL training academy in in Nebraska and this is going to be really helpful for them because y’all are bringing in people from all over the world so David I’m glad I’m so glad it’s going to be helpful um and thank you for doing that because we know we need drivers so we want as many prepared drivers out on the road as possible so that’s that’s great um Aldo will a fail during roadside tests and being put out of out of service hit our CSA scores you bet

yep and it’s not going to feel good so um all the more reason to do your screenings and you know set your company standard pretty high because again we don’t know what it means to pass or fail um in terms of like how they value u no I’m not saying that well um h how many things you can get wrong or get right so um that seems like it’s left at the discretion of the officer so I think that means that y’all as the carriers need to to hold yourselves to a pretty high standard unfortunately and um you know just assume that it’s going to be really challenging out there um Zach Zachary excuse me Zachary we will probably have to sit with these drivers when they take the exams to make sure they don’t use help from another person or translation tool yes absolutely i think that’s one of the failings of the the version that’s in you know the quiz only version is you if you’re signing it out and they’re doing it on their own time absolutely they can have you know their app pulled up um on the side looking at the you know Google Translate or or WhatsApp or whatever or have another person doing that that is the risk you’re going to run that’s why again I I really like the digital checklist version it’s just that that has to be conducted in person so it takes more time of course to make it through your fleet so um you know we’re seeing I I think the suggestion from INFINITI is to do the first one and make those assignments um to get your entire fleet checked and also think of that as their their study and their practice and preparation for the conversational and then you can go into that conversational for anyone you’re concerned about um and Randy will that also be included in the states not border states oh Steve yeah that’s back to your comment is it it’s just just an exception for border yes
it’s only on the border

and I they haven’t really given a distinction of how far from the border but I think you get the idea if they’re traveling across the border coming right out of Mexico they can’t just grab a truck and and put them out of service right away so they’re making an exception there because it it may take some time before we get enough proficiency with some of those drivers uh that are coming from a different country into this country so that would be true around Canada too that’s the best of my knowledge again this could all change uh soon but that’s what they’re telling us right now

we’ll watch it um Randy where are y’all hauling out of or where all do y’all carry you You can answer that I’m just curious myself but um meanwhile I want to since I don’t see other questions coming in um want to remind everybody so the the resources that we showed in your traditional LMS classroom so the quiz only for road sign and conversational and the video those are available right now you can literally log in right now and create your assignment and go um there’s also uh the flyer that client success team has that um we will send out in follow-up to this webinar if you’d like to put that on the announcements page or if you’d like us to do that for you glad to do that um we have another webinar on oh gosh when is it uh the date is like blurry for me June 24th Tuesday June 24th Steve is sitting down with um a subject matter expert over from Drivewize to talk about this topic again so if you’d like to hear more strongly suggest you sign up for that it’s going to be a good one um and I’m trying to think what else oh I know um we uh are also watching the medical certification process changes so we might be doing something just like this webinar all over again for medical certification you might see that pop in your inbox and we’re going live in the next hour because we’re just moving quickly um I do just want to say quickly on that particular topic we already have a fantastic webinar replay available right now on our website with um Brandon from Brandon Weisman from Truck Safe um he’s a an attorney but he really understands all of the laws and regulations affecting trucking companies and he broke it down in in very easy to understand terms so great watch um we have a flyer for that as well can go up on your announcements page we also have a video explainer that you can assign to everyone in your company about what’s going on with that change basically in a nutshell um they don’t have to drivers don’t have to carry their med cards anymore but you the company do have to run MVRs way way more often and stay on top of that to make sure everything is documented digitally documented digitally where it needs to be there’s a lot of transmission of records from medical examiners to FMCSA to the state license l licensing agencies and there are a lot of places as a result that those could get lost so I think the important thing is to tell drivers to schedule their um exams early as early as possible to make sure that they’re scheduling it with a certified medical examiner and then for you all to kind of watch that process through and make sure that the record is being transmitted make sure you’re keeping your MVRs up because that can hit you too on out of service that’s that’s an important one so anyway more information coming on that in kind of separate communications and webinars Steve anything else to add to that one
no I I just think it’s um you know it’s a bit of a change and uh to kind of give everybody a bit of a heads up there’s some challenges that we’ve seen and heard already where the ME has transmitted to the National Registry i think we said FMCSA they call it the national registry and they’re supposed to transmit to the state licensing agency
and somewhere that’s fall fallen out and those licenses are not getting to the state licensing agency or the certificates and that’s caused a bit of a problem should also know there are a bunch of states that haven’t embraced this yet yeah Sean just said 14 states still not compliant i think that’s better than we saw the other day so at least
yeah it’s a little bit better but uh um you know they’re going to have to get into the game pretty quick because uh you know drivers could find themselves uh downgraded uh and not have a CDL to use so uh if their medical certification’s not correct

programs that we run into that uh they put them out there but technology may not be quite ready yet so uh be prepared for some issues
yep so plan ahead get your drivers to plan ahead oh I will say um you know while we while we have listening ears um as my my three-year-old’s teacher says um the the INFINITI platform does track licenses so if you want to add in fact I would encourage all of you to add the medical certification expiration date in there because you don’t have to i mean we we are cyber secure we’ve gone through several protocols for that because we are an approved um training provider for entry- level driver training so we had to go through a pretty robust process for the FMCSA but um anyway there’s no issue with housing the medical expiration date under the licensing section of the user so I would encourage all of you to do that we have notifications set up attached to that so it’ll you know pop a warning up in the classroom saying “Hey this is expiring soon.” And then it’ll also send notifications out to both driver and admin that that um that expiration is coming up so you can use it for all sorts of things not just licenses but um that medical would be a great thing to track in there so that you know everyone gets alerts when you see that coming um yeah I see a question about a border crossing at Canada you know if you have uh French-speaking drivers uh they certainly will be assessed just like anybody else uh to make sure that they’re proficient in English so uh wherever they might be pulled over uh they can expect that to happen uh so uh but right at the borders again uh they they won’t be put out of service necessarily it’s my understanding that there is a little bit of leeway given uh right along the borders in Iowa as your question says maybe not they probably would be put out of service if they’re that far into the country

um I think if y’all don’t mind I’m going to go and share screen really quickly because um Sean said regarding the license tracking I think wow that’s awesome that will that it will notify the driver i need to know how to do that so I think let me see if I can demo this real quick and we’ll just do it all live together um let’s see let me go back to the user return to list okay so I’m in as an admin right now i went into the user list we’re going to go to the first user listed who happens to be called Bendover so that’s fun whoever created that one um over here under the licenses tab you can add a license um there are all sorts of different options you can add your own options i think we have one so let’s just say medical card expiration i think it would really be medical certification you’ll enter whatever you know number you want to add you’ll add the expiration date keep the statuses active and then um you know off to the races so there are some uh automatic notifications attached to that and uh we’re working on expanding those i think current notifications are at start at 30 days we’re going to get that expanded out to 90 days so you’ll have more lead time to get everything squared away
that’s the quick and dirty you can get a better a better demo of that from your client success rep and that expiration or that the license expiration notice will reside in the classroom also so anytime one of your users is logged into the classroom they’ll be able to see when that is set to expire that would be the end date would be the expiration date y
there’s also a report that they can pull on regularly if they just want to see it all at once
oh yeah
yeah you can run a report too that’s right
